Terms of Service

The Short Version

ERstat provides emergency room wait time information for informational purposes only. It is not medical advice. Wait times shown are estimates and may not reflect actual conditions when you arrive. ERstat is free, has no warranty, and its operator's total liability to you is capped at CAD $100. By using ERstat you agree to these Terms. In a medical emergency, always call 911 immediately.

1. Acceptance of Terms

By accessing or using ERstat — including the website at erstat.ca, the ERstat mobile app, email or SMS notifications, the hospital portal, browser push notifications, and any related services (together, the “Service”) — you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service.

The Service is operated by Suboptimal Development (“ERstat”, “we”, “us”, “our”). These Terms form a binding agreement between you and Suboptimal Development.

We may update these Terms from time to time. Material changes will be indicated by updating the “Last updated” date above. Your continued use of the Service after changes constitutes acceptance of the updated Terms. For significant changes affecting your rights, we will provide reasonable notice in advance through a notice on the Service.

2. Description of the Service

ERstat aggregates publicly available emergency room wait time data from provincial health authorities and individual hospital systems across Canada. Where wait time data is not published by a public source, ERstat may generate estimates (“predictions”) based on statistical models trained on historical data from similar hospitals.

The Service is provided free of charge. Optional features include alerts (by email, SMS, or browser push), community wait time reports, and a portal for hospital staff. Some optional features require providing contact information as described in our Privacy Policy.

Data is provided “as is” and “as available”. ERstat does not independently verify the accuracy of data published by third parties (provincial health authorities, hospital systems, or hospital portal users), and does not guarantee that any wait time, closure status, hospital information, or prediction reflects actual current conditions at any hospital.

3. Not Medical Advice

The Service does not provide medical advice. All content on ERstat — including wait time estimates, closure information, predictions, hospital details, the care guide, and pharmacy information — is for general informational purposes only and is not a substitute for professional medical advice, diagnosis, or treatment.

Never disregard professional medical advice or delay seeking it because of information you read on ERstat. If you think you may have a medical emergency, call 911 or your local emergency number immediately and go to the nearest emergency department. Do not wait, and do not rely on wait time information shown on the Service to decide whether to seek emergency care.

All Canadian emergency departments use the Canadian Triage and Acuity Scale (CTAS) to prioritize patients. Patients with more serious conditions are always seen first, regardless of arrival time or displayed wait time. A shorter posted wait time does not guarantee you will be seen sooner.

4. Accuracy and Limitations of Data

Wait times, closure statuses, hospital information, and predicted values shown on the Service are estimates compiled from third-party sources or generated by statistical models. They may be inaccurate, incomplete, out of date, or unavailable. Specifically and without limitation:

Before traveling to a hospital based on information shown on ERstat, you should call the hospital directly to confirm operating status, hours, and current conditions.

5. No Warranties

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ERSTAT DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, AND TIMELINESS.

Without limiting the foregoing, ERstat does not warrant that the Service will be uninterrupted, secure, or error-free, that defects will be corrected, that the Service or the servers that make it available are free of viruses or other harmful components, or that any information obtained through the Service is accurate, reliable, or current.

6. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ERSTAT, ITS OPERATOR, AFFILIATES, EMPLOYEES, AGENTS, AND CONTRIBUTORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, WHETHER ARISING IN CONTRACT, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE, RESULTING FROM:

IN NO EVENT SHALL THE TOTAL AGGREGATE LIABILITY OF ERSTAT AND ITS OPERATOR TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE EXCEED ONE HUNDRED CANADIAN DOLLARS (CAD $100), REGARDLESS OF THE THEORY OF LIABILITY OR WHETHER WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

You acknowledge that the Service is provided free of charge, that the limitations set out in this Section reflect a reasonable allocation of risk, and that these Terms would not be entered into on the same economic terms without such limitations.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages. To the extent any limitation in these Terms is held unenforceable, ERstat's liability shall be limited to the maximum extent permitted by applicable law.

7. Indemnification

You agree to indemnify, defend, and hold harmless ERstat, its operator, affiliates, employees, agents, and contributors from and against any and all claims, liabilities, damages, losses, costs, expenses, and fees (including reasonable legal fees) arising out of or relating to: (a) your access to or use of the Service; (b) your violation of these Terms; (c) your violation of any rights of any third party; or (d) any decision made or action taken or not taken by you in reliance on information displayed by the Service.

8. User Submissions

Some features of the Service allow users to submit content, including community wait time reports and corrections. By submitting content you grant ERstat a non-exclusive, royalty-free, perpetual, irrevocable, worldwide license to use, reproduce, modify, publish, display, and distribute that content for the purposes of operating and improving the Service.

You represent and warrant that any content you submit is accurate to the best of your knowledge, that you have the right to submit it, and that it does not violate the rights of any third party or any applicable law.

9. Hospital Portal Users

If you access the Service as a hospital portal user — including as an employee, volunteer, charge nurse, or authorized representative of an emergency department — the following additional terms apply to your use of the portal:

10. Intellectual Property

The Service, including its design, code, content, graphics, and trademarks (excluding user-submitted content and third-party data sourced under applicable open-data or fair-dealing terms), is owned by the operator of ERstat and is protected by Canadian and international intellectual property laws. You may not reproduce, distribute, modify, scrape, or create derivative works of the Service or its content without prior written permission, except as expressly permitted by these Terms.

ERstat displays third-party data from provincial health authorities and hospital systems under applicable open-data licenses and fair-dealing provisions. Attribution to source authorities is maintained where required.

You may link to ERstat pages, embed wait time information through any official ERstat embed or API, and quote brief portions of the Service with attribution, in each case provided you do not misrepresent the source or imply endorsement.

ERstat may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including violation of these Terms. Upon termination, the sections of these Terms that by their nature should survive (including without limitation Sections 4, 5, 6, 7, 8, 10, 12, 13, and 14) will survive.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Province of Nova Scotia and the federal laws of Canada applicable therein, without regard to conflict of laws principles. You agree that any dispute arising out of or relating to these Terms or the Service shall be brought exclusively in the courts of Nova Scotia, and you consent to the personal jurisdiction of those courts.

To the fullest extent permitted by applicable law, you and ERstat agree that any dispute resolution proceeding will be conducted only on an individual basis and not as a class, consolidated, or representative action. If for any reason a claim proceeds in court rather than in individual arbitration, you and ERstat each waive any right to a jury trial.

14. General

Severability. If any provision of these Terms is found to be unenforceable by a court of competent jurisdiction, the remaining provisions will remain in full force and effect, and the unenforceable provision will be modified to the minimum extent necessary to make it enforceable while preserving its intent.

No Waiver. No failure or delay by ERstat in exercising any right under these Terms will operate as a waiver of that right, and no single or partial exercise of any right will preclude further exercise of that or any other right.

Assignment. You may not assign these Terms without ERstat's prior written consent. ERstat may assign these Terms in connection with a merger, acquisition, restructuring, or sale of assets.

Entire Agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and ERstat regarding the Service and supersede all prior agreements or understandings.
